TERMS AND CONDITIONS OF USE OF THE NETWORK OF THE THREE SEAS
REGIONS WEBSITE
I. GENERAL PROVISIONS
- The website of the Network of the Three Seas is available at: www.3seasnetwork.lubelskie.pl (hereinafter: “Website”) and is provided by Lubelskie Voivodeship on the domain lubelskie.pl
- The website is a service available in English, dedicated to the Network of Three Seas Regions and created as part of Action 2 “Creation of a platform and website” as part of the project “Network of Three Seas Regions – a tool for cooperation between Central European local governments”, a public task financed by the Ministry of Foreign Affairs of the Republic of Poland in the “Public Diplomacy 2022” competition (hereinafter referred to as the “Project“). The website consists of 2 modules:
- public part – used for promotion of the Network, containing descriptions of its individual members, information on cooperation, implemented activities and
- the authorized part – available only to logged in users (Authorized Users) – members of the Network, within which the Network member will be able to: edit the content concerning them within the Network, as well as look for partners for joint implementation of projects among other members of the Network. This part is intended to foster cooperation between regions.
- The owner and administrator of the website is the Lubelskie Voivodeship with its registered office in Lublin, A. Grottgera 4, 20-029 Lublin NIP: 712-29-04-545 Regon: 431019170.
- These Terms and Conditions of Use (hereinafter: “Regulations”) define the terms of use of the Website, including in particular technical requirements, rules for registration of authorized Users, the procedure for deleting the Authorized User Account and the rights and obligations of Users and Authorized Users.
- These Regulations are free of charge and permanently available to all Users.
- Definitions:
- Website administrator: Lubelskie Voivodeship, which provides its IT infrastructure and network resources, including the lubelskie.pl domain, for the purpose of creating a website of the Three Seas Regions Network.
- Data: all information about the Authorized User, including, but not limited to, name and surname, contact details, image and a short biography, placed voluntarily by the User authorized in the resources of the Website.
- Account: an individually marked set of resources marked with a login (e-mail address) and password, including the data of the authorized User, information about his activities on the Website, created after the authorized effective registration on the Website.
- Registration: a procedure aimed at obtaining basic information about the Authorized User in order to give him a unique login and password and to set up an authorized Account on the Website by the User.
- Network: The Economic Network of the Three Seas Regions, also referred to as the Network of the Three Seas Regions initiated by the Lubelskie Voivodeship, as a format of direct cooperation between local governments from twelve countries of the Three Seas Initiative (Austria, Bulgaria, Croatia, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Polish, Romania, Slovakia and Slovenia) as a result of signing the Lublin Declaration on the establishment of the Three Seas Regions Economic Network on 29 June 2021.
- AuthorizedUser – a natural person designated to represent one of the member regions of the Network, who has registered on the Website and after logging in gains access to the account held on the Website.
- User – a natural person other than the User, an authorized person browsing the content or using the Website without registration and prior login.
II. TECHNICAL CONDITIONS NECESSARY TO USE THE WEBSITE
- For proper and uninterrupted use of the Website, the User and the Authorized User should have a terminal workstation equipped with software, have Internet access and an Internet browser.
- The website of the Network of the Three Seas Regions is compatible with commonly used web browsers, e.g. Internet Explorer/Edge, Chrome, Firefox, Safari, Opera.
- If for the correct and uninterrupted use of the Website it is necessary to install additional software on the User’s or Authorized User’s workstation, the download, installation and use of this software is the subject of a separate agreement between the User or the Authorized User and the licensor of this software.
III. TERMS OF USE OF THE WEBSITE
- The use of the Website shall be the basis of these Regulations, except in cases where the provisions of the Regulations refer to other special regulations.
- Access to the Website is available to all Users of the public Internet network.
- The use of the Website by Users and Authorized Users is free of charge.
- The Website Administrator is responsible for running the Website.
- Technical matters related to the functioning of the Website shall be the responsibility of The Lublin Centre of Technology and Innovation, with its registered office at Mieczysława Karłowicza 4, 20-027 Lublin, e-mail: kontakt@lcit.lubelskie.pl, tel.: +48 81 4416 501.
- The Website presents information content on topics related to the promotion and activities of Network members as well as promotional and advertising content regarding products and services of third parties / Users.
- As part of the Website, Authorized Users may use electronic services enabling them to present themselves and disseminate content from them, as well as to communicate.
- In particular, Users have the right to:
- to view the content posted on the Website,
- use links referring to other websites and external information portals. By using the links, the User goes to a site belonging to another owner. The Website administrator is not responsible for the privacy and data protection policies of the website belonging to another owner,
- downloading the content of text files made available on the Website and multimedia files,
- use of websites and electronic services provided by third parties.
- The website administrator is not responsible for the use of information and data published on the Website and the decisions made on their basis by the User. Such responsibility rests solely with the User.
- Each User and Authorized User is obliged to use the Website in a manner consistent with the provisions of these Regulations and the provisions of applicable law.
- The User and the Authorized User use the information available on the Website at their own risk and responsibility.
- Actions of the User or Authorized User that may hinder or destabilize the functioning of the Website are not allowed. In the event of such actions being committed by an authorized User, the Website Administrator is entitled to block his Account with immediate effect.
- The User and the Authorized User are liable for the culpable act or omission that led to the damage. The User and the Authorized User undertake to satisfy all claims of third parties, as well as those pursued before the court addressed to the Website Administrator, and related to the inconsistent with the Regulations or otherwise prohibited behavior of the User / User authorized.
IV. AUTHORIZED USERS:
Registration
- The use of the part of the Website available for logged in users only by the Authorized User, shall be possible only after their Registration.
- Registration takes place using the Registration Form located on the website, by providing a login (e-mail address), password and other data indicated in the Registration Form. It is not allowed to provide incomplete or false data.
- Registration is free of charge and voluntary and may take place only after prior to and acceptance of the Regulations and the Information Clause regarding the processing of personal data. The Regulations and Information Clause are available free of charge at any time on the Website in a manner that allows them to be obtained, reproduced and recorded by the User and Authorized User.
- After completing the Registration Form, accepting the terms and conditions of the Regulations and the Information Clause, a message confirming/rejecting the Registration will be sent to the e-mail address indicated by the User.
- Personal data of the Authorized User, provided during registration, are saved in the Authorized User’s Profile within the Account, to which the Authorized User is granted access on the basis of an individual login (e-mail address) and password.
- By completing the Registration Form or updating the data on the Website, the authorized User confirms that the data entered by him is true and has the right to dispose of them.
- The Authorized User is obligated to protect the password to the individual Account within the website from third parties. The authorized User is responsible for all actions of persons to whom he has provided data enabling the use of his Account on the Website, including for the actions of persons who came into possession of the indicated data, as a result of the negligence of the Authorized User in proper data protection.
- Upon Registration, the Authorized User gains full access to the authorized part of the Website, including the possibility to publish content referred to in Art. 9 point 1-3.
- Upon confirmation of Registration, the Authorized User shall gain access to the authorized part of the website and shall have the possibility to perform the following actions:
- voluntarily publish their data in the public section such as name, surname, image, contact details and a short bio in English,
- publish information about their region in English,
- publish information in English about various types of activities carried out by the region represented by the Authorized User within the Network, including implemented projects, established cooperation, organized events, etc.,
- publish announcements in English regarding the possibility of joint implementation of projects, searching for a partner(s) for joint implementation of projects,
- publish announcements in English regarding the willingness to implement projects under specific financial programs.
- The Website Administrator informs that the performance of the above-mentioned activities is available only to authorized Users who have successfully passed the Registration process and have an active Account.
- The content referred to in Art. 9 points 4, 5 will be available only to Authorized Users in the authorized part of the Website, available only to logged in users.
- The content referred to in Art. 9 points 1-3 will be available to both Authorized Users and Users using the public part of the Website.
- The publication of the information referred to in Art. 9 points 1-3 will at all times take place after taking in consideration the applicable requirements regarding the availability of this information for persons with particular needs in accordance with the provisions of:
- Directive (EU) 2016/2102 of the European Parliament and the Council of 26 October 2016 on the accessibility of the websites and mobile applications in public sector bodies,
- Act of 19 July 2019 on ensuring accessibility to persons with special needs (Journal of Acts of 2022, item 2240),
- Act of 4 April 2019 on digital accessibility of websites and mobile applications of public entities (Journal of Acts of 2023, item 82).
- The Authorized User shall be responsible at all times for the publication of the information referred to in Art. 9 points 2-3 in accordance with the accessibility requirement.
- Accessibility requirements for persons with special needs shall include in particular:
- adaptation of all shared documents and multimedia files to the needs of people with disabilities;
- all visual elements containing audio track should include subtitles for people with hearing impairment;
- all multimedia elements should have a non-visual, correctly formulated audio description;
- all photos should have alternative descriptions.
- The Website Administrator reserves the right to ask the Authorized User to remove or edit the content made available by them, which:
- contains errors or is not accessible to people with disabilities,
- violates the rights of third parties, including personal rights or copyrights or related rights of the Website Administrator, other Users, Authorized Users or third parties,
- contains words commonly considered abusive,
- which violates the law, decency or legitimate interests of the Website Administrator,
- for other reasons it should not be published in this form.
- The Authorized User is obliged at all times to verify the content of the information and data subject to publication.
- The Website Administrator shall not be liable for the consequences resulting from publication of incorrect information and data.
- The Authorized User is entitled to post files in the following formats: JPEG (JPG, JPE), PNG, SVG, PDF, DOC, DOCX.
- The assessment of the technical feasibility of placing the content, information and data to be published in formats other than those specified in paragraph 19 shall be carried out by the Data Administrator.
- The Website Administrator shall not be responsible for the content and data published by Authorized Users.
- Publishing on the Website information and data contrary to the law, including those violating the personal rights of third parties, as well as inconsistent with the principles of social coexistence or decency is prohibited. The Website Administrator reserves the right to remove them.
- The Authorized User bears full and sole responsibility for the accuracy of the data and information posted on the Website, including liability towards persons whose rights have been infringed as a result of providing such data or information.
- All information posted on the Website is subject to the copyright of its creators. By making publications, the Authorized User agrees to use them for non-commercial purposes. The use of information published on the Website for commercial purposes requires the consent of its author.
- Upon completing the Registration and receiving an e-mail confirming the Registration, the Authorized User gains access to an individual Account on the Website after logging in using the login and password indicated during the Registration. T
- The Account of the Authorized User on the Website contains personal data: name and contact details: e-mail address and telephone number indicated in the Registration Form. In addition, the Authorized User may or may not attach their profile picture and a short biography in English (up to 250 characters).
- Each Authorized User may have no more than one Account on the Website.
- The Account is identified using the login, which is the e-mail address provided by the Authorized User during registration.
- The Website Administrator may block the Authorized User’s Account in the following situations:
- violation of the provisions of the Regulations,
- disclosure of actions of the Authorized User committed to the detriment of the Website Administrator or other Users and/or Authorized Users,
- notification by another User or authorized User, a third party, an institution or body appointed to prosecute crimes of justified suspicion of violation of the authorized law by the User.
Account Deletion
- The Authorized User may at any time resign from his Account without giving reasons. To do this, it is sufficient to send a message to the Website Administrator at the following e-mail address: 3seas.network@lubelskie.pl .
- The User, along with the request to delete the account, informs the Administrator which of the authorized information posted by the User should be removed from the website.
V.RIGHTSANDRESPONSABILITIESOFTHEADMINISTRATOR
- The Website Administrator provides Users with general and free access to the Website.
- The Website Administrator undertakes to grant access to the Website to properly registered Authorized Users.
- The Website Administrator is not responsible for interruption of continuity in access to the Website caused by external factors resulting from circumstances beyond the control of the Website Administrator (e.g. force majeure, acts or omissions of third parties).
- The website administrator shall not be responsible for:
- the Authorized User’s use of the login and password and for the possible consequences of making them available to third parties, as well as their loss, theft, etc.,
- lack of access to the Website due to unusual configuration of the User’s or Authorized User’s equipment or other reasons attributable to them.
- The Website Administrator reserves the right to introduce temporary interruptions in the functioning of the Website in order to maintain, remove system disruptions or changes, without prior notification to Users and Authorized Users.
- The Administrator will make available on the Website the results of the Project having the characteristics of a work in accordance with the provisions of § 22 of the Grant Agreement no. BDG-331/2022 of June 8, 2022 conclude between the Data Administrator and the Minister of Foreign Affairs Republic of Poland. The results of the project having the characteristics of a work will be published by the Website Administrator under the Creative Commons Attribution 4.0 license. Access to the Project results published in this way will be granted to Users and Authorized Users.
VI.AMENDMENTS TO THE TERMS OF USE OF THE WEBSITE
- The Administrator reserves the right to introduce changes to these Regulations without prior notification of Users and Authorized Users.
- Amendments to the Regulations shall come into force by posting an appropriate statement on the Website.
- The User and/or the Authorized User using the Website after introducing changes to the Regulations agrees to the changes made to the Regulations and accepts its content.
VII.OTHER PROVISION
- Use of the resources of the Website by the User implies acceptance of the provisions of the Regulations.
- By registering, the authorized User declares that the wording of the Regulations is unambiguous for them and has been presented in a manner understandable to them. The Authorized User confirms that they have read the Regulations, accepts and undertakes to comply with its provisions.
- In the event of a dispute between the Administrator and the User and/or the Authorized User or between Authorized Users and/or Users, all parties undertake to resolve it by agreement.
- The law applicable to all legal relations arising from these Regulations is Polish law. Any disputes will be resolved by competent Polish common courts.
- The content of these Regulations is available in two language versions, Polish and English. In case of interpretation doubts, the language of interpretation shall be the Polish version.
- In matters not regulated by the Regulations, in particular to submitting declarations of intent in electronic form, the provisions of the Civil Code and other acts in force in the territory of the Republic of Poland shall apply.
- The Website contains copyrighted works, trademarks and other original content, in particular texts, photos, graphics, sounds, IT programs and multimedia materials.
- The use of the content made available on the Website does not mean that Users acquire any rights to intangible property to the works or databases made available.
- The User may use the works and/or databases on the Website only within the scope of permitted use, in accordance with the provisions of the Act of 4 February 1994 on copyright and related rights (i.e. Journal of Laws of 2022, item 2509), the Act of 27 July 2001 on the protection of databases (i.e. Journal of Laws of 2021, item 386) and other applicable items. It is forbidden to copy, modify or transmit electronically or in any other way any part of the Portal and/or Services in whole or in part for commercial purposes and without the prior written consent of the Administrator, except for cases specified in generally applicable laws.
- Correspondence related to the use of the Website is directed to the e-mail address made available on the Website, i.e. 3seasnetwork@lubelskie.pl
